前總統馬英九被控5年前處理時任立法院長王金平、民進黨立委柯建銘等人所涉司法關說案，將特偵組仍在偵辦中的案情告知時任行政院長江宜樺等人，因此涉犯洩密等罪嫌，一審無罪，高院今(15)日二審改判馬英九有罪，應處 4 月徒刑，可易科罰金 12 萬元，全案可上訴。對此，柯建銘表示，馬英九終於為其毀憲亂政付出代價，如同《菜根譚》所言：「弄權一時，淒涼萬古。」

柯建銘指出，無論在審理過程或是接受媒體採訪時，他都一再重申「本案判決的重要性絕對不亞於任何一次憲法法庭」。馬英九在九月政爭時，要求檢察總長黃世銘向其報告案情，指揮檢調系統辦案，監聽立法委員並且進行政治鬥爭，他始終對外宣稱其行為是「守護憲法」，實際上這種行為已是特務治國，更勝兩蔣時期，縱然蔣介石再世，亦不敢如此玩法弄權，若此行徑未受到司法追訴，將使總統成為權力無所節制的獨裁者，前人為了台灣民主奮鬥的血淚與成果都會付之一炬，因此，檢察官對於馬英九提起公訴，並非是政治追殺，而是為了捍衛憲政體制，守護共同努力而來的民主台灣。

柯建銘說，高等法院此次判決，無疑是確立民主憲政的里程碑，二審法官深具法律專業與憲法良知，實實令人敬佩。過去司法不受到人民信任，即是因為法官的判決常常因人設事，濫用自由心證，不過，司法體系中，仍有充滿正義感的法律人，體現「法不阿貴，繩不繞曲」的諍言明訓，本次法官無畏壓力，勇敢地跟憲法站在一起，共同對抗侵害民主憲政的巨靈，判決馬英九有罪，讓司法青天重現。

柯建銘表示，二審法院認定馬英九觸犯刑法、通訊保障監察法以及個人資料保護法等三罪，並沒有院際調解權的適用，且人民通訊自由為憲法保障之基本權，行政機關不得無故侵害，法官更認為馬英九所稱的「總統機密特權」是臨訟狡辯之詞，，因而判決四個月有期徒刑，得易科罰金，顯然輕判，但對於捍衛憲政體制卻有一槌定音的效果，確立總統不得假借「行政特權」而恣意侵害「法治國原則」之金科鐵律，此次判決，無疑是台灣憲政史上最重要的一頁，其意義絕對不亞於任何一次的憲法法庭！

柯建銘強調，馬英九在審判過程中，不斷批評他進行關說，他嚴正駁斥絕無此事，更願意支持任何不法關說罪等相關立法，民進黨決心捍衛法律價值，勇於承擔憲法守護者的重責大任！

柯建銘最後說，「捍衛憲政體制，終結特務治國」是他提起告訴的核心價值，馬英九身為總統，不思福國利民，只在乎政治鬥爭，汲汲營營於權力之中，有如戴上魔戒而無法自拔，在法院判決有罪後，他更該謙恭自省、懺悔前愆，而不是大聲嚷嚷、文過飾非，他在此呼籲馬英九認罪，留下最後僅存的政治人物尊嚴，「萬般帶不去，只有業隨身」，利用卸任後的時間，好好贖一贖毀憲亂政的罪孽。
